Terms & Conditions

1. Company Overview

PureForm Packs LLP is engaged in the manufacturing and supply of PET packaging solutions, including PET jars, bottles, preforms, caps, closures, and customized packaging products for the nutraceutical, pharmaceutical, food & beverage, cosmetics, and allied industries.

2. Quotations

All quotations are valid for 15 days from the date of issue unless otherwise stated. Prices are based on current raw material costs and are subject to revision without prior notice. Taxes, freight, insurance, tooling, mould charges, and any statutory levies are additional unless specifically mentioned.

3. Purchase Orders

Purchase Orders (POs) become binding only after written acceptance by PureForm Packs LLP.

The buyer shall ensure that:

• Product specifications
• Drawings
• Artwork
• Quantity
• Packaging requirements
• Delivery schedule

are accurate before confirming the order.

4. Minimum Order Quantity (MOQ)

MOQ varies depending on the product category.

Customized products may require higher minimum order quantities.

5. Customized Products

For customized bottles, jars, preforms, colours, printing, sleeves, labels, moulds, or packaging:

Customer approval is mandatory before production. Once production begins, orders cannot be cancelled or modified. Tooling and mould development charges, where applicable, are non-refundable.

6. Payment Terms

Unless otherwise agreed:

• Advance payment may be required before production.
• Balance payment shall be made as per agreed commercial terms.
• Delayed payments may attract interest at 18% per annum.

Ownership of goods remains with PureForm Packs LLP until full payment is received.

7. Production & Lead Time

Production timelines depend upon:

• Product type
• Order quantity
• Customization
• Material availability

Estimated delivery dates are indicative only and shall not constitute a contractual obligation.

8. Delivery & Risk

Delivery shall be made Ex-Works, FOB, CIF, or any mutually agreed Incoterm.

Risk transfers to the buyer immediately upon dispatch from our manufacturing facility or handover to the transporter.

9. Inspection & Acceptance

The buyer shall inspect goods immediately upon receipt.

Any manufacturing defect, shortage, or transit damage must be reported within 48 hours of delivery.

No claims shall be entertained thereafter.

10. Returns

Returns shall only be accepted for:

• Manufacturing defects
• Incorrect products supplied
• Quality issues verified by PureForm Packs LLP

Customized products are non-returnable unless a manufacturing defect is established.

11. Product Specifications

Minor variations in:

• Colour
• Weight
• Finish
• Dimensions

within industry-standard tolerances shall not constitute defects.

12. Intellectual Property

All product designs, technical drawings, moulds, catalogues, website content, trademarks, and branding remain the exclusive intellectual property of PureForm Packs LLP.

Unauthorized copying or reproduction is prohibited.

13. Confidentiality

Any technical drawings, pricing, quotations, mould designs, commercial discussions, or confidential information shared between both parties shall remain confidential and shall not be disclosed without written consent.

14. Limitation of Liability

PureForm Packs LLP shall not be liable for:

• Indirect losses
• Business interruption
• Loss of profits
• Production delays
• Consequential damages

Total liability shall never exceed the invoice value of the supplied goods.

15. Force Majeure

PureForm Packs LLP shall not be liable for delays caused by events beyond reasonable control, including:

• Natural disasters
• Fire
• Flood
• Pandemic
• Government restrictions
• Labour disputes
• Power shortages
• Raw material shortages
• Transportation disruptions

16. Governing Law

These Terms shall be governed by the laws of India.

Any disputes shall be subject exclusively to the jurisdiction of the courts located in Mohali, Punjab, India.
